The petitioners apprehend their arrest in Narpatganj (Basmatiya) P.S. Case No.455 of 2019 registered under Sections 448, 341, 323, 325, 354, 427, 504 and 506 of the Indian Penal Code.

The informant alleged that the accused persons entered into his shop and broke the chulha and bhatti and threw the same on the road. They also broke the showcase of the shop and threw the articles on the road. When the father of the informant raised a protest, the accused persons, namely,

Patna High Court CR. MISC. No.84921 of 2019(3) dt.26-06-2020 2/2 Krityanand Sah (petitioner no.1) and Om Prakash Sah (petitioner no.2) assaulted the informant and his father with iron rod. Thereafter the accused persons entered into his house and damaged other properties.

Learned counsel for the petitioners submits that there is a counter version being Narpatganj (Basmatiya) P.S. Case No.454 of 2019. The injuries found on the persons of the injured are simple in nature caused by hard and blunt object. Having considered the facts that there is a case and counter case and both sides entered into scuffle in which the informant and his father got simple injuries, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Narpatganj (Basmatiya) P.S. Case No.455 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
