The petitioners seek bail in connection with Tharthari P.S. Case No. 156/2019 for the offence under sections 341, 323, 307, 504/34 of Indian Penal Code and section 27 of the Arms Act.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case without any cogent material against them and F.I.R itself shows that occurrence took place due to admitted land dispute. No specific overt act has been attributed against the petitioner no. 2 rather the allegation against him is general and omnibus in nature. The

No.83389 of 2019(2) dt.18-01-2020 2/2 allegation against the petitioner no. 1 that he assaulted the injured by lathi at forehead is false and concocted, as the injury report does not reflect any injury on his forehead. None of the witnesses have come forward to support the allegation against the petitioners. Petitioner no. 1 is in custody since 14.10.2019 and petitioner no. 2 is in custody since 23.10.2019. Considering the facts and circumstances of the case, let the, above named, petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Hilsa, Nalanda in connection with Tharthari P.S. Case no. 156/2019.
