2. The petitioners apprehend their arrest in connection with Ropou P.S. Case No. 147 of 2025 registered for the offence under Sections 126(2), 115(2), 117(2), 109, 303(2), 351(2), 352 and 3(5) of the BNS.

3. As per the prosecution case, the petitioners are said to have assaulted the victim.

4. It has very fairly been submitted by the learned counsel for the petitioner that during the pendency of this application, the petitioner no. 01 has been arrested and he prays for withdrawal of this application filed on behalf of the petitioner no. 01.

5. Permission is accorded and accordingly, this application is dismissed as withdrawn with regard to petitioner no. 01.

6. So far as petitioner no. 2 is concerned, the allegation of assault is against the petitioner no. 02 but the injury caused to the victim is simple in nature.

7. Considering the fact that the injury caused to the victim is simple in nature, this application is allowed with regard to petitioner no. 02.

8. Let the petitioner no. 02, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Vth Class, Nawada/concerned Court below in connection with Ropou P.S. Case No. 147 of 2025, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
