JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-11-2020 Heard learned counsel for the petitioner and Ms. Sharda Kumari, learned APP for the State. The petitioners, who are the brother and sisterin-law of the deceased, seek bail in anticipation of their arrest in connection with Darauli P. S. Case No. 152 of 2019 dated 20.09.2019, instituted for the offences under Sections 304 (B) and 120 (B) of the Indian Penal Code.

The learned counsel for the petitioners has submitted that the accusation against them is general and omnibus and the husband of the deceased is in

The allegations have only been brought about because of the relationship of the husband of the deceased with the petitioners.

Regard being had to the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, IIIrd, Siwan, in connection with Darauli P. S. Case No. 152 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed.
