The petitioners are apprehending their arrest in connection with Warsaliganj P.S.Case no.360 of 2018 , registered for offences punishable under Sections 420, 467, 468, 471, 419/34 of the Indian Penal Code.

Allegation against the petitioners is that they were duping the public by making advertisement and drawing lucky draw and collected huge amount and when the police raided arrested two persons but the petitioner and other accused persons succeeded in fleeing away Submission of the learned counsel for the petitioners is that they have been made accused only on the basis of confessional statement of the co-accused persons and similarly

Patna High Court CR. MISC. No.79414 of 2018(3) dt.01-03-2019 2/2 situated another co-accused has been granted privilege of anticipatory bail, vide order dated 8.1.2019 passed in Cr. Misc. No.78302 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Warsaliganj P.S.Case No.360 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
