The petitioner seeks regular bail in connection with Siswan PS case no. 134 of 2019 instituted for the offence punishable under Sections 395, 397 of Indian Penal Code. The allegation is regarding commission of dacoity in the house of the informant by unknown miscreants and subsequently, it appears that the name of the petitioner has transpired in the present case upon the confessional statement made by the co-accused namely Tej Pratap Gore. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that similarly situated coaccused persons have already been granted bail by co-ordinate
Patna High Court CR. MISC. No.87503 of 2019(3) dt.17-01-2020 2/2 Benches of this Court vide orders dated 09.12.2019 passed in Cr.Misc. no. 79937 of 2019 and the one dated 07.01.2020 passed in Cr. Misc. no. 80544 of 2019. The petitioner is said to be languishing in custody since 26.08.2019.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that co-accused persons have already been granted bail by co-ordinate Benches of this Court, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Siswan in connection with Siswan PS case no. 134 of 2019.
