JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1386 of 2017 in which cognizance has been taken under Section 498A of the Indian Penal Code.

Prosecution story as per complaint petition is that petitioner and other accused persons demanded Rs.1 lac from the complainant and on denial they tortured and threatened her and ultimately ousted her from the house.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her with dignity and care but she is not ready to reside with the petitioner.

No.80808 of 2018(6) dt.10-07-2019 2/2 In this case notice was issued to opposite party No.2 and it appears from office note that she received the notice personally but on the last date none had appeared on behalf of opposite party No.2 or any Vakalatnama has been filed and this case was directed to be posted today and today also none has appeared on behalf of opposite party No.2.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Miss. Amrita Singh, Judicial Magistrate, 1st Class, Gaya, in connection with Complaint Case No. 1386 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
