The petitioner is languishing in custody since 19.11.2019 in a case registered for the offences punishable under Sections 414/34 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that the SHO, Yadavpur intercepted a motorcycle when two persons were apprehended namely, the petitioner and one Chunnu Kumar Ram. From the motorcycle, 51.950 litres of illicit liquor were recovered. It is submitted by learned counsel for the petitioner that the petitioner was only the pillion rider. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Statement has also been made in paragraph 9 of the petition that the petitioner has no concern

Considering the quantity of recovery, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge -II-cum-Special Judge, Excise, Gopalganj in connection with Yadavpur P.S.
