The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
The prosecution case is that two vehicles were robbed by unknown miscreants and subsequently, one of the vehicles was recovered and during enquiry, it was found being stolen, from which, 261 litres illicit liquor were recovered, leading to registration of Revilganj P.S. Case No. 139 of 2019 under Section 30(a) of Bihar Prohibition and
Patna High Court CR. MISC. No.86581 of 2019(2) dt.20-02-2020 2/3 Excise Act, 2016. In the connected case the confession of co-accused Rajbir Singh was made and the petitioner made accused in Revilganj P.S. 139 of 2019 in which he has been granted anticipatory bail by Co-ordinate Bench of this Court vide order dated 27.08.2019 passed in Cr. Misc. No. 53580 of 2019.
It is submitted by learned counsel for the petitioner that except confession there is no material against the petitioner and petitioner is not having any criminal antecedent prior to two cases.
Learned APP submits that the name of the petitioner sprang up on the confession of co-accused.
Considering the fact that the impugned order does not suggest that except confession of co-accused, there is any material against the petitioner and the petitioner has been granted anticipatory bail in connected case, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Revilganj P.S. Case No. 138
