The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366A of the Indian Penal Code.

The prosecution case is that on 25.07.2019 at 10.00 pm when the informant slept with his family at about 12 o'clock night Sarita Kumari aged about 13 years fled away with petitioner for the purpose of marriage. The daughter of the informant also took ornaments and some cash from her home and other one is also involved in this case. On the basis of written petition of informant, the instant case has been registered.

Learned counsel for the petitioner submits that there is

Patna High Court CR. MISC. No.84457 of 2019(3) dt.18-03-2020 2/2 no contradiction between the statement of victim under Section 161 Cr.P.C. and Section 164 of the Cr.P.C. He submits that she came at the house of her sister with the petitioner and also stated that she has performed her marriage with the petitioner in a temple. He further submits that petitioner is in jail since 02.08.2019.

In the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. 1st Bagaha, District West Champaran in connection with Dhanha P.S. Case No. 134 of 2019.
