JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Barhara P.S. Case No. 216 of 2018 dated 30.10.2016 instituted for the offences under Sections 341, 323, 326, 307, 498(A) of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act.
The petitioner No. 2 is the sister of the husband of the informant whereas petitioner No. 1 is the husband of petitioner No. 1.
The informant has alleged in the F.I.R that her husband, with the help of these petitioners poured kerosene oil on her body and set her on fire, for non-fulfillment of dowry demand.
Patna High Court Cr.Misc. No.79284 of 2018(2) dt.28-01-2019 2/2 The learned counsel for the petitioners has submitted that there is general and omnibus allegation against the petitioners. The petitioners live separately from the husband of the informant and the specific accusation of setting her body on fire is against the husband of the informant.
Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Barhara P.S. Case No. 216 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
