The petitioner seeks regular bail in connection with Shahkund (Sajour) P.S. Case No. 31 of 2018 for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
The allegation is regarding commission of theft in the shop of the informant by unknown accused persons and various articles like lap-top, JIO FI Device etc. were stolen. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, no T.I. Parade has been held and no recovery has been made from conscious possession of the petitioner. It is further submitted
Patna High Court Cr.Misc. No.79400 of 2018(2) dt.18-01-2019 2/2 that though the petitioner is accused in two other cases, but he is on bail in those cases. It is further submitted that the petitioner is languishing in custody since 08.08.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bhagalpur in connection with Shahkund (Sajour) P.S. Case No. 31 of 2018.
