JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 379, 376, 511, 504/34 of the Indian Penal Code.

Although, there is specific allegation against the petitioner that he entered into the room of informant at about 10 p.m and made attempt to commit her rape but as a matter of fact, the reality is otherwise which is reflects from the written report itself.

Learned cousnel for the petitioner further submits that the petitioner and informant had some sweet relation and the talk of marriage was going on but unfortunately due to some reasons, the aforesaid talk could not materialized. As a

It is further submitted that moreover, petitioner is in jail custody since 25.10.2018 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Biraul, Darbhanga in connection with Ghanshyampur P.S.
