JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 Petitioner seeks bail in anticipation of her arrest in connection with Bhadwar P.S. Case No. 05 of 2018 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner, who is mother-inlaw of the deceased, is of causing death of the deceased along with other accused persons by poisoning her.

Submission of learned counsel for the petitioner is that there is no specific allegation attributed against the petitioner and further she has been made accused only because she is mother-in-law and moreover she is not residing with the deceased.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.686 of 2019(3) dt.22-02-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sherghati (Gaya), in connection with Bhadwar P.S. Case No. 05 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
