JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This is an application for grant of anticipatory bail in connection with Darpa P. S. Case No. 117 of 2019 disclosing offences under Sections 272 and 273of the Indian Penal Code and Section 30(a)of the Bihar and Prohibition Act, 2016. Recovery of 35 liters of Chulai liquor from a Bamboo Clump.

Submission of the learned counsel for the petitioner is that the Bamboo Clump is of one Kanhai Lal Sah, it appears from the F.I.R. as well as seizure list. He has no criminal antecedent. He is in custody for more than a month. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the

S. Case No. 117 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
