JUSTICE MADHURESH PRASAD ORAL ORDER 16-01-2020 Heard learned senior counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners seek bail in a case registered under section 302, 307 and other allied sections of the IPC. It is submitted that allegations made in the F.I.R are general and omnibus without attributing any specific assault against instant petitioners. Altogether, 18 persons including petitioners are said to have assaulted informant's brother who has subsequently succumbed to his injuries.

Incident alleges to have taken place due to previous enmity with other co-accused Umesh Prasad against whom there is similar allegation has already been allowed bail in Cr. Misc. no. 83662/2019.

Patna High Court CR. MISC. No.85836 of 2019(2) dt.16-01-2020 2/2 Petitioners have no criminal antecedent and they are in custody since 11.10.2019.

Submission is also based on parity with co-accused Umesh Prasad.

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Jehanabad in Makdumpur P.S. Case no. 453/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(2) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
