JUSTICE BIRENDRA KUMAR ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Nawa Nagar (Sonevarsa) P.S. Case No.198 of 2018, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Though liquor was not recovered from the possession or house of the petitioner and name of the petitioner surfaced in the statement of co-accused that he was business partner, considering the criminal antecedent of the petitioner of the same nature, I am not inclined to grant anticipatory bail to the petitioner.

Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner, the prayer
