The petitioners apprehend their arrest in connection with Sitamarhi (Punaura O.P.) P.S. Case No. 853 of 2018 registered under Sections 406 and 420 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that on perusal of first information report, it would be evident that there is specific allegation against co-accused persons namely, Bibi Hasina Khatoon and Md. Khurshid @ Khursaid. There is no
Patna High Court CR. MISC. No.3161 of 2020(3) dt.01-02-2022 2/2 specific allegation against the petitioners and have no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi (Punaura O.P.) P.S. Case No. 853 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
