Petitioner seeks bail in a case registered for the offences punishable under Sections 147,148,149,302,506 of the Indian Penal Code and 27 of Arms Act.

Co-accused-Anil Panjiyara, co-accused-Nawal Panjiyara, the petitioner and co-accused- Jadgambi Panjiyara are alleged to have fired at the father-in-law of the informant, as a result whereof, he died. The Doctor has found four wounds of entry and some wound of exit also on the person of the deceased.

Earlier prayer for bail to the petitioner was refused on 02.04.2018 considering the nature of allegation and

The Petitioner is in custody since 20.09.2017. The report of the learned Trial Judge dated 21.02.2019 reveals that the case is at the stage of hearing on charges.

Considering the entire facts especially period already undergone by the petitioner and no chances of conclusion of the trial in near future, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.313 of 2018( arising out of Amarpur {Fullidumar} P.S.Case No.357 of 2016), subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
