The petitioner seeks regular bail in connection with Amarpur P.S. Case No. 62 of 2016 registered for the offence punishable under Section 379 of the Indian Penal Code. The allegation is regarding unknown accused persons having committed theft of Bolero vehicle of the informant. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case inasmuch as no recovery has been made from the conscious possession of the house of the petitioner. It is submitted that only after the petitioner was arrested in connection with Akbarnagar P.S. Case No. 65 of 2016, he has been remanded in the present case. Patna High Court Cr.Misc. No.79490 of 2018(2) dt.22-01-2019 2/2 cases pending against the petitioner herein, the petitioner has been acquitted in one case and in one other case final form has been filed by the Police while he is on bail in the third case. It is further submitted that the petitioner is languishing in custody since 20.08.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 62 of 2016.
