The petitioner seeks bail in Bisfi (Patauna) P. S. Case No. 129 of 2018 instituted for the offence under Section(s) 147,148, 149, 341, 323, 324, 307, 332, 333, 353, 109, 114, 117, 427, 435, 379, 504, 506 and 511 of the IPC and Section 3 of Damage and Public Property Act.

Learned counsel for petitioner submits that there is general and omnibus allegation levelled against this petitioner in the Fardbeyan.

It is alleged in the written report that Ganga Nath Jha (Mukhiya) handed over a person to the police alleging him to be child lifter. Thereafter, mob assembled at the house of

Patna High Court Cr.Misc. No.765 of 2019(2) dt.21-01-2019 2/2 Ganga Nath Jha and started raising slogan against him after surrounding his house.

Petitioner is said to be member of unlawful assembly. Learned counsel for the petitioner submits that other accused with similar allegation have already been granted regular bail by this Hon'ble Court by order dated 26.9.2018 passed in Cr. Misc. no. 58230 of 2018 .

Petitioner is in custody since 10.09.2018 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Benipatti, in connection with Bisfi (Patauna) P. S. Case No. 129 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
