The petitioner apprehends his arrest in connection with Jalalpur P.S. Case No. 238 of 2018 registered for the offences punishable under Sections 272, 273, 420, 467, 468, 471, 188/34 of the Indian Penal Code and Sections 30/ 30(a)/41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is recovery of 5400 liters of spirit from the Truck. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that he is innocent and has been falsely implicated in this case due to village dirty politics. He further submits that nothing was recovered from the possession

Patna High Court CR. MISC. No. 84390 of 2019(2) dt.14-02-2020 2/2 of the petitioner and the name of the petitioner has come in this case at the instance of the co-accused and petitioner has no criminal antecedent.

In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.50,000/- in the court below/ Nazarat and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of A.D.J.-cum-Special Judge (Excise), Saran in connection with Jalalpur P.S. Case No. 238 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Such deposit of Rs.50,000/- shall abide by the outcome of the criminal case.
