Petitioner apprehends his arrest in Kasim Bazar P.S. Case No.199 of 2017 registered under Sections 147, 149, 447, 341, 427, 379 and 420 of the Indian Penal Code. The informant filed Complaint Case No.299C/2017 which was sent to the police station for registration and investigation under Section 156(3) Cr.P.C. The informant alleged that the lands of Plot No.833 and others were settled in his favour in the year 1933 and 1950 but the accused persons including the petitioner came to the land and damaged the crops. Learned counsel for the petitioner submits that there is bona fide land dispute and on account of which this false case has been lodged.
Considering the facts aforesaid and nature of
Patna High Court Cr.Misc. No.80112 of 2018(2) dt.15-01-2019 2/2 allegation made against the petitioner and the fact that there appears to be land dispute between two sides, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kasim Bazar P.S.
