The petitioner apprehends his arrest in connection with Khaira P.S. Case no. 176 of 2015, registered under Section 392 of the Indian Penal Code.

The accusation is that after withdrawing cash of Rs. 84,000/-, informant proceeded on 07.08.2015 from S.B.I. Gopalpur, in the way, at about 1.00 P.M., three persons came boarding on the motorcycle and stopped his motorcycle and on the point of pistol they snatched Rs.84,000/- kept in a bag. Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of written report of informant Dilip Kumar Thakur, Khaira P.S. Case no. 176 of 2015, registered under Section 392 of the Indian Penal Code

Patna High Court CR. MISC. No.80731 of 2018(6) dt.06-05-2019 2/2 against unknown and in course of investigation, Nirbhay Rawat was apprehended by the Police and he confessed his guilt and he also disclosed the name of petitioner, except that nothing has been collected against the petitioner.

On the other, learned counsel appearing on behalf of the informant submits that in course of investigation, the name of the petitioner surfaced on the information given to the I.O by spy. Thereafter, Police got apprehended Nirbhay Rawat and he disclosed the name of petitioner as his associate. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 176 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
