JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This application, for grant of anticipatory bail, arises out of Barachatti P.S. Case No. 368 of 2019, disclosing offences under Sections 147, 342, 323, 379, 307, 452, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioners is that they entered inside the house of the informant and on the point of pistol snatched away ornaments and also misbehaved with the female members of the family of the informant.

Submission of learned counsel for the petitioners is that son of the informant is accused in excise cases and

No.83860 of 2019(2) dt.18-12-2019 2/2 informant suspects that petitioners have informed the police about the same and due to which, this present false case has been lodged and no such occurrence as alleged by the informant has ever taken place. Further submission is that there is case and counter case between the parties.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No. 368 of 2019, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.
