This application is for grant of regular bail in connection with Noorsarai P.S.Case No.195 of 2019 for the offences under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and three other accused persons is that they called the son of the informant and killed him by firing at him.

Submission of the learned counsel for the petitioner is that one of the witness has taken the name of one Lallu Mahto, who has fired and the postmortem report also disclosed only one fire arm injury on the person of the deceased. Heard learned A.P.P. and the learned counsel for

Patna High Court CR. MISC. No.87088 of 2019(3) dt.28-02-2020 2/2 the informant, who has opposed the prayer for bail on the ground that there are allegation that all the accused persons including the petitioner has taken the deceased and thereafter he was killed..

Having heard both sides and considering the submissions at this stage, I am not inclined to grant bail to the petitioner , however, once the charge is framed, the petitioner is at liberty to renew his prayer for bail.

Accordingly, this application is dismissed.
