ANJANA MISHRA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.08.2018 in connection with Ahiyapur P.S. Case No.879 of 2018, G.R. No.5393 of 2018 registered for the offence under Sections 467, 468, 411 and 120B of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that soon after his arrest in connection with Ahiyapur P.S. Case No.879 of 2018, G.R. No.5393 of 2018, the petitioner was remanded in connection with several other cases and in three of such cases, the petitioner has already been granted bail. Learned counsel for the petitioner further submits that he is willing and ready to cooperate in any further investigation.
Patna High Court Cr.Misc. No.79669 of 2018(3) dt.21-02-2019 2/3 Learned counsel submits that the petitioner was taken into custody on mere suspicion and the alleged recoveries were not from his conscious possession. It is further submitted that the police personnel took his signature on blank paper and later on, the same was converted into confession, which has no evidentiary value.
Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No.879 of 2018, G.R. No.5393 of 2018, subject to the following conditions:
(1) Father will be the bailor of the petitioner.
(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his
Patna High Court Cr.Misc. No.79669 of 2018(3) dt.21-02-2019 3/3 bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
