The petitioner seeks bail in Turkauliya P.S. Case No. 575 of 2018, instituted for the offence under Section(s) 342, 120B, 366B, 370(2), 370(3), 370(5), 370(A) (1), 376(A) (2), 372, 373, 376/34 of the Indian Penal Code, Sections 4, 5, 6, 7(ii) (c), 9 of Immoral Trafficking Act, Sections 8, 12 of POCSO Act, Sections 75 and 26 of Juvenile Justice Act. Counsel for the petitioner submits that co-accused Manan Ansari @ Mannan Ansari has already been granted bail by this Court vide order dated 4.12.2018 passed in Cr. Misc. 72130 of 2018.
In the written report it is alleged that police after
Patna High Court Cr.Misc. No.80251 of 2018(2) dt.01-02-2019 2/3 getting information that petitioner along with co-accused Rakesh Kumar Sah are indulging in human trafficking, sexual exploitation and forcing the girl to dance in Orchestra party in the name of providing employment, raided the house of Mannan Ansari and co-accused Rakesh Kumar Sah and found three male and female persons in questionable condition. The statement of victim girls after recovery have been recorded under Section 164 Cr. P.C. wherein they have stated that they were working in Orchestra party. They have stated that no illegal act was being performed by them. One of the victim girls namely Anju Rajak in her statement recorded under Section 164 Cr. P.C. has stated that she came with this petitioner for catering work. He sold her to the owner of the house for performing dance. She has further stated that some altercation took place for money for which she was not allowed to go home.
From the statement of victim girl it appears that she was performing in orchestra party and some altercation took place due to payment of money.
Petitioner is in custody since 4.9.2018 having clean antecedent.
In such circumstances, prayer for bail of the
Patna High Court Cr.Misc. No.80251 of 2018(2) dt.01-02-2019 3/3 petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge cum Special Judge, East Champaran at Motihari, in connection with Turkauliya P.S. Case No. 575 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
