JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-02-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Tajpur (Waini O.P.) P.S. Case No.307 of 2018 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Considering the allegation of involvement of the petitioner in supply of Indian made foreign liquor through one Uma Das as also the provision prescribed under sub-section (2) of Section 76 of the Bihar Prohibition and Excise Act, 2016, I am not inclined to grant him pre-arrest bail. The application for grant of pre-arrest bail is

In case, the petitioner surrenders and seeks bail the same shall be considered on its own merits without being prejudiced in any manner by this order.
