JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 This is an application for grant of anticipatory bail in connection with Sultanganj P.S. Case No. 173 of 2018, disclosing offences under Sections 498(A), 341, 323, 34 of the Indian Penal Code and 3⁄4 of the D.P. Act.

Allegation against the petitioner is of subjecting his wife to cruelty with respect to demand of rupees one lac. Submission of learned counsel for the petitioner is that he is still ready to keep the informant with himself. Further he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.1615 of 2019(2) dt.23-01-2019 2/2 2019 before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV Patna City, Patna, in connection with Sultanganj P.S. Case No. 173 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that he will cooperate in disposal of the trial and at the same time if any case for maintenance is being filed by the informant, the petitioner shall cooperate in the said maintenance case, otherwise the informant will be free to move for cancellation of the bail bonds of the petitioner before the learned court below itself.
