Having availed leave with effect from 27.04.2017, petitioner's counsel submits that the petitioner joined on 08.05.2017.

Records reveal that there is a report of the Sergeant Major that petitioner had not joined pursuant to availing leave within time. Petitioner disputes the report and submitted before the Senior Superintendent of Police, Patna claiming that for the period between 27.04.2017 to 15.05.2017, he has claimed his

Patna High Court CWJC No.214 of 2019(3) dt.27-06-2019 2/2 leave to the said period. In the instant proceedings also, it is petitioner's submission that upon his joining on 08.05.2017, he was issued a command duty.

If the petitioner submits the same before the Senior Superintendent of Police, Patna (respondent No 7) in respect of his application (Annexure 3) along with a fresh application, respondent No 7 shall consider the same and pass orders thereupon in accordance with law.

The entire exercise be completed within three months from submission of application by the petitioner, which should be submitted within four weeks.

Writ petition stands disposed of.
