The petitioner apprehends his arrest in connection with Ram Nagar P.S. Case No. 232 of 2019 registered under Sections 498(A), 494 of the I.P.C. and section 3⁄4 of the Dowry Prohibition Act pending in the Court of A.C.J.M.-III, Bagaha, West Champaran.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. There is general and omnibus allegation against the petitioner. Further submission is that petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.87028 of 2019(6) dt.25-11-2021 2/2 Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that petitioner is husband of the informant/opposite party no. 2. There is allegation of demand of dowry and torture against this petitioner. There is no chance of settlement in between the parties. Hence, the petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
