JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Mansahi P.S. Case No. 111 of 2013, dated 12.12.2013, instituted for the offences under Sections 147, 148, 149, 307 and 323 of the Indian Penal Code.

It has been alleged in the First Information Report that several persons in two auto-rickshaws came to the house of the informant and indulged in assault. The

Patna High Court Cr.Misc. No.79875 of 2018(2) dt.16-01-2019 2/2 petitioners are drivers of those two auto-rickshaws which were used by the other accused persons for reaching/arriving at the house of the informant.

The petitioners have clean antecedents and are not specifically alleged to have participated in the assault. Considering the aforesaid facts, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VIth, Katihar in connection with Mansahi P.S. Case No. 111 of 2013, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
