The petitioner seeks bail in connection with Punpun P.S. Case No.297 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 15.11.2019 in a case of recovery of 275 litres of countrymade liquor from the dickey of a car. He has further contended that co-accused Vikash Kumar whose case stands on identical footing to that of the petitioner has already been granted bail by a co-ordinate Bench of this Court vide order dated 16.03.2020 passed in Cr. Misc. no.81014 of 2019.

Patna High Court CR. MISC. No.83723 of 2019(3) dt.17-03-2020 2/2 Learned counsel for the State has opposed the prayer for grant of bail to the petitioner.

Considering the nature of allegation, period undergone by the petitioner in custody, the fact that the investigation is complete and that a co-accused whose case is identical in nature has already been granted bail, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Spl. Case No. 10127 of 2019 arising out of Punpun P.S. Case No.297 of 2019 . (Ashwani Kumar Singh, J) kanchan/- U T
