Petitioner apprehends his arrest in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

Informant in his written complaint has alleged that while he was coming on his motorcycle alongwith his nephew three unknown miscreants intercepted him and looted his motorcycle and mobile on the strength of arms and fled away with the looted motorcycle.

It has been submitted on behalf of the petitioner that the name of the petitioner has surfaced in this case as the looted mobile was being used by the petitioner. It has been further submitted on behalf of the petitioner that he was not aware that the mobile which he had purchased is looted mobile and except

Patna High Court CR. MISC. No.84481 of 2019(2) dt.19-12-2019 2/2 said allegation that he was using the looted mobile there is no any other incriminating material against the petitioner. Petitioner is aged 57 years and is agriculturist. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above in the event of his/her arrest or surrender before the court below within a period of four weeks, be released on anticipatory bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Goreyakothi P.S. Case No. 89 of 2019, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
