JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Barachatti P.S. Case No. 286 of 2019 for the offence under Sections 15, 18, 20 and 22 of the Narcotic Drugs & Psychotropic Substances Act.

The allegation against the petitioner is that he is involved in smuggling of opium.

Learned counsel for the petitioner submits that the petitioner, who is the owner of the truck, has no criminal antecedent and he is in custody since 14.07.2019. He submits that in this case similarly circumstanced co-accused persons, namely, Mithu Yadav, Yogendra Singh Bhokta and Kauleshwar Yadav @ Kouleshwar Yadav have been granted bail by

Patna High Court CR. MISC. No.85869 of 2019(5) dt.02-07-2020 2/2 coordinate Benches of this Court vide orders dated 18.10.2019, 25.10.2029 and 04.12.2019 passed in Cr. Misc. No. 59270 of 2019, Cr. Misc. No. 63011 of 2019 and Cr. Misc. No. 60523 of 2019 respectively.

Considering the fact that the petitioner has no criminal antecedent and similarly circumstanced co-accused persons have been granted bail by coordinate Benches of this Court, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 5,00,000/- (Rupees five lakhs) with two sureties of the like amount each to the satisfaction of 9th Additional Sessions Judge cum Special Judge, N.D.P.S., Gaya in connection with Barachatti P.S. Case No. 286 of 2019.
