JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2019 This is an application for grant of anticipatory bail in connection with Darbhanga Sadar P.S. Case No. 86 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 302, 120(B) of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of causing death of the deceased, who was father-inlaw of the informant. Further it appears that the petitioner is accused in 3 other cases.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and also there is land dispute between the parties and so far other cases are concerned, he is on bail. Heard learned A.P.P. also, who opposed the prayer for

Patna High Court Cr.Misc. No.80048 of 2018(3) dt.31-01-2019 2/2 anticipatory bail of the petitioner, but also accept that there is general and omnibus allegation against him.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Sadar P.S. Case No. 86 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
