2. The petitioner seeks pre-arrest bail in connection with Dehri (T) P.S. Case No. 375 of 2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution in short is that two persons were transporting 90 liters of country-made liquor on a bike.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner has been falsely implicated in the case. Learned counsel for the petitioner submits that the petitioner has been implicated in this case as he is the owner of the said bike. He also submits that nothing has been recovered from the possession of the petitioner. The petitioner was having no

Patna High Court CR. MISC. No.88878 of 2025(2) dt.30-01-2026 2/2 information regarding the alleged recovery. He also submits that two persons who were carrying the liquor have been granted regular bail by this court passed in Cr. Misc. No. 68540 of 2025.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner and submits that the petitioner is having criminal antecedent of one case.

6. Considering the nature of allegation against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-I, Rohtas at Sasaram in connection with Dehri(T) P.S. Case No. 375 of 2025 subject to the condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
