JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2019 The petitioner seeks regular bail in connection with Jehanabad P.S. Case No. 81 of 2019, registered for offences punishable under Section 414/34 of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R., there is allegation against the petitioner that when he got down from the train, police intercepted him and recovered several articles such as Laptop, Laptop Charger, Power Bank, Airtel Dongle, Mobile Phones and other articles, which was suspected to be stolen articles. It further appears that petitioner is accused in two more cases.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has remained in custody for four months and there is nothing on record to show that any case was lodged for theft of the articles, which were

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Rail Judicial Magistrate, Gaya, in connection with Jehanabad P.S. Case No. 81 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required.
