The petitioner, already in custody, seeks bail in connection with Nabinagar P.S.Case No. 47 of 2018 registered under Sections 147, 148, 149, 307, 323, 324, 325, 341, 354, 332, 333, 353, 379, 427, 435, 504 and 120B of the Indian penal Code.

Allegation in brief is that one child was killed in a road accident and a large number of people gathered indulged in arson and assaulted police personnel and also two of the accused Dhananjay Singh and Bhola Sao snatched away SLR rifle from the constable of Special Armed Forces.

Submission is that there is no specific accusation against the petitioner regarding doing assault to anyone and of snatching the rifle. Petitioner has no criminal antecedent and has been in custody since 27.02.2018.

Patna High Court Cr.Misc. No.39225 of 2018(2) dt.06-07-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Sri Niwas Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Aurangabad in connection with Nabinagar P.S. Case No. 47 of 2018.
