ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 02.10.2019 in connection with Tilauthu P.S. Case No.166 of 2019 registered for the offence under Section 30(A) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were from Bans Bari and not from the conscious possession of the petitioner and that he has one other case under the Excise Act in which he has already been released on bail.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)

Patna High Court CR. MISC. No.86848 of 2019(2) dt.20-01-2020 2/2 with two sureties of the like amount each to the satisfaction of the learned court of 2nd Additional District & Sessions Judge cum Special Judge, Excise, Rohtas at Sasaram, in connection with Tilauthu P.S. Case No.166 of 2019.
