2. The accused-petitioners, named in the F.I.R., are apprehending their arrest in connection with Turkauliya P.S. Case No. 1239 of 2023 registered for the offences punishable under Sections 341, 323, 324, 307, 387, 504/34 of the Indian Penal Code, later on section 302 was added.
3. The allegation against the petitioners is to assault the father of the informant by means of spade (Kudal), who received injury on his head. It is alleged that petitioners alongwith other co-accused persons were demanding extortion money of Rs. Five Lakhs from the father of the
Patna High Court CR. MISC. No.89805 of 2025(2) dt.12-02-2026 2/3 informant.

Learned counsel appearing on behalf of the petitioners submitted that from perusal of the allegation as alleged through F.I.R., it would manifest that allegation of assaulting the father of the informant i.e. deceased is against Rahul, who is alleged to have assaulted him by spade, causing injury on head, leading to death during the course of treatment in the hospital, after 12 days of the occurrence.
5. Learned counsel further submitted that similarly situated co-accused namely, Dinesh Kumar has already been granted privilege of anticipatory bail by one of the learned coordinate Bench of this Court vide order dated 29.07.2024 through Cr. Misc. No. 44587/2024.
6. It is further submitted that as far these petitioners are concerned, they are the female family members having clean antecedent. It is submitted that petitioners will not abscond rather will cooperate in the investigation.
7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
8. In view of the aforesaid factual submissions and by

No.89805 of 2025(2) dt.12-02-2026 3/3 taking note of the fact as allegation against these petitioners qua committing assault upon father of the informant, not appears convincing on its face, coupled with the fact that petitioners are ladies having clean antecedent, accordingly, above-named petitioners, in the event of their arrest/surrender within a period of four weeks from this order, is directed to be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari/concerned court in connection with Turkauliya P.S. Case No. 1239 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
