The petitioner apprehends his arrest in connection with Pakribarawan P.S. Case No. 239 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise, Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 30 liters of country made liquor from the motorcycle. The motorcycle belongs to the petitioner but he is not present at the spot. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent.

In the facts and circumstances of the case, I am

Patna High Court CR. MISC. No.637 of 2020(2) dt.24-02-2020 2/2 inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.6,000/- (six thousand) in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Nawada in connection with Pakribarawan P.S. Case No. 239 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
