JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioners seek bail in anticipation of their arrest in connection with Akbarpur P.S. Case No. 353 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 354B, 307, 504 and 506 of the Indian Penal Code.

As per FIR allegation is that petitioners have come at the house of the informant and abused him and asked him why he has taken electricity from the motor and specific allegation of assault is against the petitioners.

Submission of learned counsel for the petitioners is that there was dispute with respect to taking of electricity and for that scuffle took place and though impugned order discussed

Patna High Court CR. MISC. No.83892 of 2019(2) dt.18-12-2019 2/2 about injury report but does not show any serious injury on any person and other allegations are ornamental in nature. Heard learned APP also.

In view of above facts and circumstances, let petitioners surrender within a period of three weeks from the receipt of this order and on surrender they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nawada, in connection with Akbarpur P.S. Case No. 353 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
