The petitioner seeks regular bail in connection with Ara Nawada P.S. Case No. 690 of 2019 for the offence registered under Sections 109 and 115 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act. The allegation is regarding the Police having received secret information that certain criminals were planning to murder one Vishwanath Singh whereupon during the course of checking one motorcycle was intercepted and the co-accused person, namely, Ankit Kumar Singh was arrested from whom various arms and live cartridges were recovered and he is said to have disclosed in his confessional statement about the complicity of the petitioner herein.

No.83825 of 2019(2) dt.17-12-2019 2/2 The learned counsel for the petitioner submits that neither the petitioner has been arrested from the spot nor any illegal arms has been recovered from his nor there is any material to show the complicity of the petitioner in any sort of crime. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 07.09.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur in connection with Ara Nawada P.S. Case No. 690 of 2019.
