Petitioners seek bail in Barun P.S.Case No.97 of 2018 registered for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120(B) of the I.P.C. and Section 3⁄4 of Prevention of damage of Public Property Act, 1984. Allegation as per the F.I.R. is that when on receipt of information about road blockage due to vehicular accident in which one person became badly injured, the police personnel reached there the mob attacked on the police party and also committed arson.
Submission of the learned counsel for the petitioners is that though the petitioners are named in the F.I.R. no specific
Patna High Court Cr.Misc. No.46910 of 2018 (3) dt.19-09-2018 2/2 allegation of overt act has been attributed against the petitioners, they are in custody since 18.05.2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad, in Barun P.S. Case No.97 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioners will not induce any witness or tamper with the evidence and the petitioners shall co-operate in disposal of the trail and make themselves available as and when required by the court, otherwise, their bail bonds shall be cancelled.
