JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 51 of 2019 arising out of East Colony P. S. Case No.17 of 2018 for the offenses under Sections 341, 323, 326, 307, 354, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Allegation against this petitioner is that he has assaulted the informant on her wrist with sharp cutting weapon which chopped off her hand. There is delay of nearly 9 days in lodging the FIR. He further submits that the petitioner has voluntarily surrendered in the court below on 24.11.2018 and he is languishing in jail since then.

No.84768 of 2019(4) dt.04-06-2020 2/2 Considering the fact that the petitioner has no criminal antecedent and he is in custody since 24.11.2018, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV, Munger in connection with Sessions Trial No. 51 of 2019 arising out of East Colony P. S. Case No.17 of 2018. However, the Court below is directed to expedite the trial and conclude the same in all respect latest by 15th of January, 2021.

The petitioner is directed to extend full co-operation in the conclusion of the trial and in the event any delay is caused on behalf of the petitioner, the court below shall be at liberty to cancel his bail bond.
