The petitioner, already in custody, seeks bail in connection with Sitamarhi (Mehsaul O.P.) P.S.Case No. 401 of 2018 registered under Sections 341, 323 and 307/34 of the Indian penal Code.

Allegation in brief is that while informant's son was going to drop his cousin's to his village and he was watching a quarrel and someone stabbed him.

Submission is that FIR is against unknown and impugned order clearly indicates giving reference of the specific paragraph of the case dairy that one co-accused Anish Singh inflicted a knife blow to the person of the informant's son and not this petitioner.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.48695 of 2018(2) dt.07-08-2018 2/2 the petitioner, namely , Dibyanshu Kumar @ Nehal is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Sitamarhi (Mehsaul O.P.) P.S. Case No. 401 of 2018.
