Petitioner, already in custody, seeks bail in connection with Laukahi P.S. Case No.250 of 2017, registered under Sections 20(b), (ii), (c) of the NDPS Act.
Accusation against the petitioner is that two person were apprehended carrying Ganja in a plastic bag and one person throwing the bag escaped away and the apprehended persons disclosed the name of the petitioner who had thrown that bag containing 13.2 Kgs. Nepali Ganja and escaped away. Learned counsel for the petitioner submits that person who was apprehended at the spot having in possession of contraband more in quantity than the quantity alleged to be thrown by the petitioner was earlier admitted to bail by a co-
Patna High Court Cr.Misc. No.48667 of 2018(2) dt.07-08-2018 2/2 ordinate Bench of this Court vide order dated 19.07.2018, passed in Cr. Misc. No.34674 of 2018, however neither there is any recovery from conscious possession of the petitioner nor has any criminal antecedent and petitioner is in custody since 11.01.2018.
Having considered the aforesaid facts and circumstances, petitioner Bhupendra Yadav @ Bhupe Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Madhubani in connection with Laukahi P.S.
