JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This application, for grant of anticipatory bail, arises out of Narpatganj (Basmatiya) P.S. Case No. 515/2019, disclosing offences under Sections 147, 149, 341, 323, 353, 188 and 225 of the Indian Penal Code.

Prosecution case is that while the police went to arrest the petitioner in connection with other case, four to five persons started scuffle with the police party allowing the petitioner to flee away.

Submission of learned counsel for the petitioner is that the real fact is that the petitioner was not present in his house and the police party abused the family members of the petitioner and on their protest, some people gathered and made scuffle with the police party.

Heard learned A.P.P. also.

No.83861 of 2019(2) dt.18-12-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
